Cat^® AI Assistant Terms

AI Functionality.
To the fullest extent permitted by applicable law, the AI functionality and the AI-generated output are provided “AS IS” and Caterpillar makes no warranty to, and assumes no responsibility  or liability for, the correctness, sufficiency, or completeness thereof or for any decisions, actions, or omissions taken in reliance on such AI‑generated output. Any business transaction or commitment proposed through the AI functionality is effective only if and when confirmed by an authorized human representative of Caterpillar or completed via an authorized Caterpillar purchasing platform (e.g., Parts.cat.com). In the event of any conflict between these AI Terms and the applicable access agreement (including the Website Terms of Use or the Onboard EULA), these AI Terms will control solely with respect to AI functionality.

Except as stated in product documentation for a particular AI functionality, you acknowledge that the AI functionality is not designed for, and must not be used to directly control any emergency or safety functions, or for uses likely to result in any AI functionality being deemed a "high-risk AI system" under the EU AI Act and any similar U.S. or other jurisdictional laws. This includes, without limitation, decisions or assessments relating to employment matters (such as performance evaluation), an individual’s creditworthiness, or any other decision that produces legal, financial, or similarly significant effects on an individual. 

Cat^® AI Assistant™.
If you access the Cat^® AI Assistant™ through a Machine (as defined in the Onboard EULA) your use is subject to the Onboard EULA (https://www.caterpillar.com/onboard-eula) and these Terms.  If you access the Cat^® AI Assistant™ through Caterpillar websites or apps or otherwise not through a Cat^® Machine, your use is subject to Caterpillar’s Website Terms of Use (https://www.caterpillar.com/en/legal-notices.html) and these Terms.

Data Use.
For the avoidance of doubt, (i) all use of the AI functionality and output is subject to the requirements in these AI Terms and (ii) Caterpillar may use any inputs to or outputs from the AI functionalities, or information otherwise made available through use of the Site, consistent with the Data Governance Statement (https://www.caterpillar.com/en/legal-notices/data-governance-statement.html), including to train computational models for the purpose of improving Caterpillar’s products and services. You understand and agree that Caterpillar is the sole owner of the results from such training and this right shall survive any termination of this Agreement.

User Responsibility.
You acknowledge that you remain solely responsible for all decisions, actions, operational decisions, and omissions in connection with your use of the AI functionalities. The AI functionality is not a substitute for your professional judgment, operator training, or safety procedures. Official Caterpillar source documents, including Operation & Maintenance Manuals (OMM), control in all cases, and you are responsible for independently validating any AI‑generated output against those sources prior to reliance or use. You are, and will remain at all times, fully responsible for the safe operation and control of the Cat^® Machine and for any reliance on or use of AI functionality.
